WHEREAS, ___(Name of the bidder)___ (hereinafter referred to as "the Bidder") has submitted a bid for the provision of ___(description of the project)___ (hereinafter referred to as "the Project") to ___(Name of the Purchaser)___ (hereinafter referred to as "the Purchaser");

WHEREAS, the Purchaser has required the Bidder to provide a bid bond as a security commitment to guarantee the fulfillment of the obligations set forth in the bid; and

WHEREAS, the Bidder has approached ___(Name of the Bank)___ (hereinafter referred to as "the Bank") to issue a tender bid bond on its behalf;

NOW, THEREFORE, the Bank hereby agrees, that upon receipt of a written demand from the Purchaser stating that the Bidder has failed to fulfill its obligations under the bid, the Bank shall pay the amount of the performance bond to the Purchaser without requiring any proof or condition other than such written demand.

This tender bid bond shall automatically expire and be void if the Bidder's bid is not accepted by the Purchaser within ___(number of days)___ days from the date of bid opening. Furthermore, this bond shall also expire and be void if the Bidder withdraws its bid before acceptance by the Purchaser.
